1. Acceptance of Terms

By accessing or using PlumbTrack(the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Service. These terms apply to all users, including company owners, administrators, technicians, and other authorized personnel.

2. Description of Service

PlumbTrack provides contractor management software, including but not limited to job scheduling, estimates, invoicing, customer management, permits tracking, lead follow-up, and related business tools. Features may change over time as we improve the platform.

3. Accounts and Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate registration information and to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these terms or pose a security risk.

4. Subscriptions and Payments

Paid plans are billed according to the pricing shown at signup or on your account. Fees are non-refundable except where required by law or expressly stated otherwise. Failure to pay may result in suspension or termination of access. Trial periods, if offered, convert to a paid subscription unless canceled before the trial ends.

5. Acceptable Use

You agree not to misuse the Service, including by attempting to gain unauthorized access, interfering with other users, uploading malicious content, scraping or reverse engineering the platform beyond what the law permits, or using the Service for unlawful purposes. You remain solely responsible for the content and data you enter into PlumbTrack.

6. Intellectual Property

The Service, including its software, design, trademarks, and documentation, is owned by us or our licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for your internal business operations during an active subscription. You retain ownership of your business data; we process it solely to provide and improve the Service.

7. Privacy Policy

We collect account information (such as name, email, company details), usage data, and content you submit (jobs, customers, estimates, and similar records) to operate PlumbTrack. We may use trusted third-party processors for hosting, authentication, payments, email, and analytics. We do not sell your personal information. We retain data while your account is active and for a reasonable period afterward as needed for legal, security, or billing purposes. You may request access, correction, or deletion of personal data by contacting support, subject to applicable law and legitimate retention needs.

Cookies and similar technologies may be used for authentication, preferences, and performance. By using the Service you consent to this processing as described herein.

8. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Estimates, calculations, permit guidance, and other outputs are tools to support your business decisions; you remain responsible for verifying accuracy and complying with all applicable laws, codes, and licensing requirements.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

10. AI Assistant — Errors and Limitations

10.1 Nature of the AI Assistant

Your use of any AI Assistant features within PlumbTrack is subject to these terms. This is standard industry practice for AI-assisted software tools.

10.2 No Guarantee of Accuracy

The AI Assistant is provided for informational and assistive purposes. It may make mistakes, mishear or misinterpret requests, omit information, or generate outputs that are inaccurate, incomplete, or not suitable for your needs. You are fully responsible for reviewing and verifying all outputs from the AI Assistant before relying on them for any business decision.

10.3 User Responsibility and Verification

• You are solely responsible for confirming the accuracy of any estimate, transcript, or summary generated by the AI Assistant.
• You agree to conduct human review of all AI-generated content before sending it to customers or using it for critical business operations.
• We recommend implementing a verification process, as is standard in the industry.

10.4 Limitation of Liability for AI Outputs

• We are not liable for errors, omissions, or losses resulting from reliance on AI-generated outputs.
• The AI Assistant is not a substitute for your independent judgment or any professional advice you may require.

11. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your use of the Service, your content, or your violation of these terms or applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these terms, non-payment, or risk to the platform. Upon termination, your right to use the Service ends; provisions that by nature should survive (including liability limits and intellectual property) will continue to apply.

13. Changes

We may update these Terms & Conditions from time to time. Material changes may require renewed acceptance before you continue using the Service. The current version is 2026-07-12.2. Continued use after notice of changes constitutes acceptance where permitted by law.
